More evidence about rape accusation uncovered

A Sacramento State student, whose rape charge was dropped by prosecutors, admitted the victim told him “No,” according to a report by KCRA 3.

The male student was arrested Oct. 18 after Sac State police said he raped a female acquaintance in the American River Courtyard residence hall. The Sacramento County District Attorney’s Office later dropped the charges due to lack of evidence.

But police reports, obtained by KCRA 3, show the victim clearly told the man their encounter had gone too far.

She said “No,” admitted the man, “(But) she said it in a way that made me think she wasn’t serious. I continued to reach into her shirt and she asked me to stop again,” according to KCRA’s report.

The victim, in a written statement to police, said the man “climbed on top of me on the couch and began having sexual intercourse with me. I begged (him) to stop, and I tried to push him off me but he wouldn’t stop,” KCRA’s report states.

The man was booked on a felony rape charge and held on $150,000 bail at the Sacramento County Jail. About a week later, the Hornet learned that the charges had been dropped.

Sac State police declined to comment for this story, and have not granted the State Hornet’s request for access to the police report.

UPDATE: The Sac State police have given The State Hornet access to the records. A full update will be posted Friday.

UPDATE (Monday, 7:13 p.m.): We have yet to receive the report. We will have an update as soon as we receive the records.
