Causeway incident trial postponed until July

The long awaited trial of two men arrested at the Sept. 18 Causeway Classic football game was delayed again on May 9.

Miguel and Gustavo Chavez trial has been postponed until July 11 because of scheduling difficulties. The delay is the result of a decision to attach the Chavez’ case with the case of Sacramento State student, Eric Guerra, who was arrested for interfering with the lawful duties of a police officer at the game in a separate incident.

Lisa Franco, G. Chavez’s attorney, said the move is a practical one.

“It’s more efficient to have the jury hear all three cases,” she said.

The main reason the case is just now going to trial is because originally Franco had subpoenaed the unpublished photographs and notes of three news organizations: KCRA-the local NBC affiliate, KXTV-the local ABC affiliate, and The State Hornet newspaper. She said the unpublished materials were important to the defense of her client.

After an in-camera review of the unpublished photos and notes, a Sacramento Superior Court judge ruled that the photos provided no new evidence to the defense and quashed the defense’s subpoena.
