CSUS student arrested in Davis

Sacramento State student Nicholas Gray was arrested by the Davis Police Department on Dec. 11 for possession of marijuana for sale, said Sacramento State University Police Public Information Officer John Hamrick.

“The arrest of Nick Gray was the result of what precipitated in the armed robbery case,” Hamrick said of an Oct. 24 robbery at the Sac State dormitories.

Gray was one of the five victims involved in the armed robbery that occurred on October 24 in Jenkins Hall. Gray?s room was the one directly involved in the robbery. Three weeks following the robbery Gray?s roommate, Tim Middleton, moved out of the dorms.

“During our initial investigation of the robbery, we learned that (Gray) had been arrested by the Davis Police Department in 2001 for drug sales at a high school and that his criminal case was still pending,” Hamrick said.

Hamrick went on to say that as a condition of his release in the 2001 Davis criminal case, Gray had a “stipulation” attached by the court that would allow police to conduct a search of his residence and possessions for drugs.

Furthermore, at least six anonymous sources had been telling University Police that Gray was selling marijuana from his dorm room. On Wednesday, Dec. 4, University Police decided to conduct a search of Gray?s room.

Upon the search, University Police found several bags of marijuana with an overall weight of approximately 2.14 ounces and a paper note known as a marker. According to Hamrick, a marker is known as an “I owe you.” Gray was not present during the search.

The marijuana and note were taken as evidence and booked into the University Union evidence room, and a receipt was left in Gray?s room describing the items that were seized, said Hamrick.

After searching Sacramento for Gray, University Police notified Davis police of the arrest warrant. According to Hamrick, Gray is a permanent resident of Davis.

University Police gave a description of Gray?s vehicle to the Davis PD who ended up stopping him.

“It is our belief that an undetermined amount of marijuana, belonging to one of more of the victims, was taken in the armed robbery. From our investigation, we feel that the presence of marijuana was the reason for the robbery itself,” said Hamrick.

The armed robbery occurred at approximately 9:30 p.m. on Oct. 24 and the robbers reportedly stole property and cash. The robbers were carrying two 45 semi-automatic handguns and another gun described as an “uzi” by one of the victims.

Later that night, there was a dispute over money that took place in Jenkins Hall and a University Police Officer responded.

The dispute was settled prior to the officers? arrival, and some of the victims of the robbery walked passed the officer and said “hello” but failed to report the robbery until one of them called University Police at 3:14 p.m. the following day.

Up to now, the robbery victims never identified the suspects. University Police had also checked up on various leads, including the Nov. 17 home invasion robbery in El Dorado Hills. University Police contacted the El Dorado County Sheriffs? Department and found that there was no connection between that case, and the Jenkins Hall robbery.

Gray, whose bail is set at $10,000, is being held at the Yolo County Jail. At this time it is unknown how much jail time Gray could face if convicted because of his other pending case.
