Men accused of gang rape cleared

Two men accused of gang raping a 19-year-old woman last month have been cleared from charges Wednesday after evidence that indicated the case could not be prosecuted was brought to the Sacramento County District Attorney’s Office, said Deputy District Attorney Noah Phillips.

Despite previous media reports, the woman is not a Sacramento State student, said Public Information Coordinator Audrey Lee of the Sacramento City Police Department.

Sarn Saecho, 25, and Chiem Saecho, 21, were facing numerous sexual assault charges, including rape in concert and sodomy, after the woman claimed she was “gang raped” for a 12-hour period on Feb. 6 and 7, according to Sgt. Terrell Marshall, police spokesman.

But after a manila envelope containing a compact disc and cell phone containing images of the alleged victim and suspects came forward Monday, Phillips said the case was dropped.

Phillips said the evidence, which was dropped off by the defense attorney, was transferred to Sacramento Police Detective Alisa Buckley. After he and Buckley reviewed the evidence, Buckley re-interviewed the alleged victim, he said.

With the new evidence in hand, the woman recanted initial claims and admitted to omitting certain facts, Phillips said. Phillips also confirmed that an exchange of money was mentioned between the parties.

“Thousands of dollars were mentioned,” he said.

Arrest warrants for two men and a 15-year-old boy for participating in the alleged rape were also dropped on March 22, Phillips said.

Whether the woman will face charges for false claims is now being reviewed.

“We’re waiting to see what the police department sends over to us,” Phillips said.

Phillips said the woman would most likely face misdemeanor charges including providing false information to law enforcement. The maximum penalty for this charge is six months in jail, he said.
